Welcome to Disco Brands (“Disco,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of discobrands.co and any related content, features, tools, newsletters, and services we provide (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.

1. About Disco

Disco is a fashion discovery and information platform. The Services may include brand directories and profiles, brand recommendations, editorial content, product information, comparisons, sizing and fit information, sales and deal information, retailer links, newsletters, brand submission tools, and other discovery features.

Disco is not a retailer and does not manufacture, sell, fulfil, ship, or accept returns for products offered by third-party retailers unless we expressly state otherwise.

2. Eligibility

You must be at least 13 years old to use the Services.

If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian.

By using the Services, you represent that you are legally permitted to do so and to agree to these Terms.

You may use the Services only for lawful purposes and in accordance with these Terms.

4. Brand Listings, Submissions, and User Content

Disco may create brand and product listings using information supplied by brands, retailers, affiliate partners, publicly available sources, or other third parties.

The presence of a brand, retailer, or product on Disco does not by itself mean that the brand, retailer, or product has sponsored, endorsed, approved, or partnered with Disco.

The Services may allow users, brands, or their representatives to submit information, images, links, corrections, descriptions, or other materials (“User Content”).

You retain ownership of User Content that you own.

By submitting User Content to Disco, you grant Disco a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, format, adapt, distribute, and otherwise use that content as reasonably necessary to operate, promote, and improve Disco and the relevant listing or feature.

You represent and warrant that:

Submission or verification does not guarantee publication, placement, ranking, or continued inclusion on Disco.

Disco may edit, format, categorize, decline, remove, or update submitted information in order to maintain the quality, consistency, accuracy, and editorial standards of the Services.

5. Product, Pricing, Sale, and Availability Information

Disco may display product information including product names, descriptions, images, retailers, prices, previous prices, suggested retail prices, discounts, availability, categories, and other product attributes.

This information may come from retailers, affiliate networks, brands, data providers, publicly available information, or other third-party sources.

Prices, discounts, inventory, availability, currencies, product details, and other information can change at any time. Although we try to provide useful and accurate information, Disco does not guarantee that any product, price, discount, availability status, or other information shown on the Services is complete, current, or error-free.

A product displayed as available or on sale on Disco may no longer be available or offered at the same price when you visit the retailer.

6. Recommendations, Rankings, and Disco Inferences

Some information on Disco represents our editorial judgment, analysis, algorithms, or inferences rather than statements made directly by a brand or retailer.

Opinions, recommendations, rankings, and inferred attributes may change as we receive new information or improve our methodology.

7. Sizing and Fit Information

Disco may provide sizing information, measurements, size-chart comparisons, fit tendencies, or recommendations about which size may work for a particular user or product.

Sizing and fit information is provided for informational purposes only.

Measurements and sizing can vary between brands, products, styles, production runs, regions, and individuals. User-provided measurements may also be incomplete or inaccurate.

Disco does not guarantee that a recommended size or product will fit you. Whenever possible, you should review the retailer's or manufacturer's current size chart, measurements, fit information, and return policy before purchasing.

8. Affiliate Links, Advertising, and Sponsored Content

Some links on Disco are affiliate links.

If you visit a retailer or make a purchase through an affiliate link, Disco may receive a commission or other compensation from the retailer, affiliate network, or another third party. This generally does not increase the price you pay.

Disco may also offer advertising, sponsored placements, paid features, or other promotional opportunities to brands and retailers.

Where appropriate, sponsored or paid content will be identified as such.

Commercial relationships may affect the placement of clearly identified sponsored content, but they do not create a guarantee that Disco will provide a positive review, recommendation, ranking, or editorial assessment.

9. Third-Party Retailers and Websites

The Services contain links to websites, products, and services operated by third parties.

When you follow a third-party link, you leave Disco and are subject to the third party's own terms, privacy policy, pricing, return policies, shipping policies, and other practices.

Any purchase you make through a third-party retailer is a transaction between you and that retailer.

10. Intellectual Property

Except for User Content and material owned by third parties, the Services and their original content, functionality, software, database organization, design, graphics, branding, editorial content, taxonomies, compilations, and other original materials are owned by or licensed to Disco and are protected by applicable intellectual property laws.

You may access and use the Services for your own lawful personal or business informational purposes.

Except as permitted by law or with Disco's written permission, you may not reproduce, republish, commercially distribute, sell, license, or create a competing database or service from substantial portions of Disco's proprietary content.

Brand names, retailer names, product names, logos, photographs, trademarks, and other third-party materials appearing on Disco remain the property of their respective owners.

Their appearance on Disco does not imply sponsorship, endorsement, approval, or affiliation unless expressly stated.

11. Feedback

If you provide suggestions, ideas, feedback, or recommendations regarding Disco, you agree that we may use them without restriction or compensation to you.

This does not give Disco ownership of User Content submitted for other purposes.

12. Privacy

Your use of the Services is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, Disco and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Services.

This includes loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses, whether or not Disco was advised that such damages were possible.

To the fullest extent permitted by applicable law, Disco's total aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of:

  1. the amount you paid directly to Disco for the applicable Services during the 12 months immediately preceding the event giving rise to the claim; or
  2. CAD $100.

These limitations do not apply where liability cannot lawfully be excluded or limited.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Disco and its affiliates, officers, directors, employees, contractors, and service providers from reasonable losses, liabilities, claims, damages, and legal costs resulting from:

We may restrict, suspend, or terminate access to all or part of the Services if we reasonably believe that you have violated these Terms, misused the Services, created a security risk, or engaged in unlawful conduct.

We may also modify, discontinue, remove, or replace features of the Services at any time.

Where reasonably practicable, we will try to avoid unnecessarily disrupting legitimate users.

17. Changes to These Terms

We may update these Terms from time to time as Disco, our Services, or applicable legal requirements change.

When we make changes, we will update the Effective Date shown at the top of this page. Where required by law or appropriate given the nature of the change, we may provide additional notice.

Your continued use of the Services after updated Terms take effect means that the updated Terms apply to your continued use, subject to any rights you may have under applicable law.

18. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-law principles.

Subject to any mandatory rights you may have under applicable consumer-protection or other laws, disputes relating to these Terms or the Services will be subject to the jurisdiction of the courts of British Columbia located in Vancouver, British Columbia.

Nothing in these Terms limits rights or protections that applicable law does not permit you to waive.

19. General

These Terms, together with our Privacy Policy and any additional terms that apply to a particular feature or service, constitute the agreement between you and Disco regarding your use of the Services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.

In the event of a conflict between these Terms and a separate written agreement between you and Disco, the separate written agreement will control with respect to its subject matter.
